Taxes and costs when buying property in Marbella (Andalusia)
On top of the price you need to add taxes and costs. In Andalusia, as a quick rule, budget an extra 9% to 14%. It depends mainly on whether the property is resale or a new build.
Resale property
- Transfer tax (ITP): 7% of the purchase price (or of the Land Registry reference value, if higher).
New build (first sale by the developer)
- VAT (IVA): 10% of the price.
- Stamp duty (AJD): 1.2%.
Costs in both cases
- Notary and Land Registry: together roughly 0.5%–1%, depending on the price.
- Gestoría (paying the taxes and registering): a few hundred euros.
- Lawyer: highly recommended; usually around 1% + VAT.
- With a mortgage: valuation (about €300–600) and sometimes an arrangement fee. The bank pays the notary and registry costs of the mortgage itself.
Example: €500,000 resale apartment
| Transfer tax (7%) | €35,000 |
| Notary, registry and gestoría (approx.) | €3,500 |
| Lawyer (approx. 1% + VAT) | €6,050 |
| Approximate total | €44,550 (8.9%) |

If the seller is not resident in Spain: the 3% withholding
When the seller is a non-resident, the buyer must withhold 3% of the price and pay it to the tax office on account of the seller's taxes. The notary and lawyer handle it, but it's good to know.
Annual costs
- IBI (municipal property tax) and the rubbish collection fee.
- Community fees, if there is a community.
- If you are not resident in Spain: Non-Resident Income Tax, even if you don't rent the property out.
- Depending on your total wealth, Wealth Tax could apply; in Andalusia it has a 100% relief, but check it with an adviser.
On each property page we show the IBI and community fees when we know them.
